TERMS AND CONDITIONS OF THE GOBI ONLINE STORE

1. Trader and scope

The online store at www.thegobi.eu is operated by Easy Company s.r.o., registered office: Podolská 1487/8a, 147 00 Prague 4, Czech Republic; Company ID: 24250651; registered in the Commercial Register maintained by the Municipal Court in Prague, file C 197223; email: info@thegobi.eu; telephone: +420 703 501 496 (the “Seller”).

These Terms govern purchases made through the online store. A “Consumer” is an individual acting outside their trade, business or profession. Consumer-protection provisions apply to Consumers. Matters not expressly covered here are governed by applicable law.

2. Products and prices

Product descriptions, essential characteristics and prices are displayed on the respective product pages. Prices include VAT and other foreseeable taxes. Delivery and payment charges, where applicable, are shown before the order is submitted.

The Seller may change prices for future orders; a concluded contract remains subject to its agreed price. If a price is clearly erroneous, the Seller is not obliged to supply goods at that obviously incorrect price. Any payment received for an order not accepted at the correct price will be refunded without undue delay. Promotional offers are subject to their individual stated conditions.

3. Orders and contract formation

The Customer places an order using the online checkout and can review and correct their information before submission. Submitting an order constitutes a binding offer to purchase. The sales contract is concluded when the Seller accepts the order by confirmation sent to the email address provided.

The Seller may decline an order, in particular if goods are unavailable, a price is manifestly incorrect or there is reasonable suspicion of misuse or fraud. If an order is declined after payment, the payment will be refunded without undue delay. Contract information and confirmation are supplied electronically. The contractual language is the language in which the order and confirmation are presented, as made available by the store.

4. Payment and delivery

Available payment and delivery methods, their costs and relevant conditions are displayed during checkout. Goods are delivered to the address or collection point selected by the Customer. Unless otherwise agreed, delivery will take place without undue delay and within the period required by applicable law.

Where the Seller arranges delivery to a Consumer, the risk of loss or damage passes when the Consumer, or a third party designated by the Consumer other than the carrier, takes physical possession of the goods. Customers are encouraged to inspect packages on delivery and notify the carrier of visible damage; this does not limit their statutory rights. Where delivery must be repeated for reasons attributable to the Customer, additional costs may be charged only to the extent permitted by law.

5. Consumer right of withdrawal

A Consumer purchasing at a distance generally has the right to withdraw from the contract without giving a reason within 14 days after taking possession of the goods. Statutory exceptions apply, including, where their conditions are met, goods supplied sealed for health-protection or hygiene reasons that are unsuitable for return and were unsealed after delivery.

To exercise this right, the Consumer must send the Seller a clear statement of withdrawal before the deadline, for example by email to info@thegobi.eu, or use the model form below. Using the model form is optional. A withdrawal notice sent before expiry of the period is timely.

The Consumer must return or hand over the goods within 14 days of notifying the Seller of withdrawal, to:

Unless the Seller expressly offers otherwise, the Consumer bears the direct cost of returning the goods. The Consumer is liable only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

The Seller will reimburse payments received under the contract, including the cost of the least expensive standard delivery method offered, within 14 days of receiving the withdrawal notice. The Seller may withhold reimbursement until the goods have been received or the Consumer supplies evidence of having returned them, whichever occurs first. Reimbursement will be made using the original payment method unless expressly agreed otherwise and without additional charges to the Consumer.

6. Statutory rights regarding defective goods

The Seller is responsible for goods conforming to the contract and mandatory legal requirements. Consumer remedies, time limits, the allocation of the burden of proof and the procedure for claiming a lack of conformity are governed by applicable law. Normal wear and damage caused by misuse or improper care do not constitute defects for which the Seller is responsible. Nothing in these Terms restricts mandatory consumer rights.

7. Complaints

A complaint may be submitted to info@thegobi.eu or by sending the goods to the return address above. Please describe the defect and the remedy requested. The Seller will issue legally required acknowledgements and process complaints within the time limits prescribed by applicable law. Where the complaint is justified, reasonable necessary costs may be reimbursed as required by law.

8. Alternative dispute resolution

If a consumer dispute cannot be resolved directly, the Consumer may use an appropriate alternative dispute resolution body. For the Seller established in the Czech Republic this is, in particular, the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 44, 110 00 Prague 1, Czech Republic; www.coi.cz, adr.coi.cz. In cross-border matters, Consumers may also seek assistance from their national European Consumer Centre.

9. Personal data

Information about the processing of personal data is provided in the separate Privacy Policy.

10. Final provisions

The contract is governed by Czech law. This does not deprive a Consumer of the protection afforded by mandatory provisions of the law of the country of their habitual residence where those provisions apply under the relevant conflict-of-law rules. The version of the Terms in force when the contract was concluded applies to that contract. Mandatory statutory rights and obligations continue to apply even if not expressly repeated here.
